But first, let’s talk about what makes a state surrogacy friendly. Here’s some of what we are looking for:
The state has clear laws on surrogacy.
The courts have favorable views on surrogacy.
The state offers the ability to obtain a pre-birth order (PBO) or other method for a birth certificate with the intended parents’ names on it
The state offers easy access to top fertility clinics.
Good prenatal care and Level III NICUs are nearby.
The state is affordable for the typical intended parent (this includes access to surrogacy friendly insurance policies).
When it comes to the Southwestern United States, Texas is one of the best places for affordable surrogacy. We know most intended parents don’t come with Kim Kardashian’s bank account. Affordability is a real consideration for many of us.
Texas offers the benefits of California, at a lower cost. Texas has some nice laws on the books, as well as judges who look favorably upon family building via surrogacy.
In Texas, the intended parents can get a birth certificate listing only their names, not the surrogate’s. The one downside is that Texas law contemplates that surrogacy will be pursued by a married couple. So single and unmarried intended parents, Texas may not be the best choice for you. (But don’t worry, other nearby states like Nevada can be good choices).
As a bonus, Texas is more easily accessible from the Midwest and Eastern parts of the country. This means a shorter flight home with the baby. Can you see why we love Texas for surrogacy?
And then there’s Arizona. Even experienced surrogacy attorneys cannot agree whether surrogacy is legal in Arizona.
